After the case was called by the court clerk, counsel to the claimant, PDP and the party chairman, Mr. Hashim Abioye Esq sought for the court to grant the motion for experte brought before the court in suit number FHC/OS/CS/30/2020.
The counsel to the claimant sought for the relief of the court to serve other defendants who are not represented in court by their counsels i.e, the Nigeria Police Force, Nigerian Army, Nigerian Navy, Nigerian Air Force, State Security Services, NSCDC, Nigerian Customs Service, Nigerian Immigration Service and Attorney General of Federation.
Counsel to the First Defendant and second defendants (i.e the Governor and Attorney General of Osun State, Barrister Jide Obisakin, and Barrister Ojeme, who appeared for Osun state house of Assembly, said they are not opposed to the request of the counsel to the claimant in as much it has no effect on the case.
However, the leading Counsel to the third Defendant in the suit, Comrade Amitolu Shittu, Barrister Yinka Muyiwa Esq, affirmed that motion has been filed in respect to the claims of the claimants, hence there is nothing in the case filed by the People Democratic Party, PDP than to waste the court time.
He said, the jurisdiction of the court has been challenged, thereby it will be an exercise in futility as the case has no effect.
He affirmed the integrity of Comrade Amitolu Shittu as a rights activist, who has distinguished himself as one of the Nigeria Pro Democracy Activists, in line with the likes of late Chief Gani Fawehinmi, Beeko Ransome-Kuti, Femi Falana, among others, to entrench democracy in Nigeria.
Barr. Yinka Muyiwa insisted that entertaining such a case in a very busy court like this is tantamount to wasting the precious time of the court.
In his ruling before adjournment, Hon. Justice N. Ayo Emmanuel, ruled that t he parties in the case be served accordingly, before the next adjourning date, which is 15th, July, 2020.
